Walgreens Sued Over PL Pistachio Packaging

Paramount Farms International LLC has sued Walgreens for trademark infringement and unfair competition after the Deerfield, Ill.-based drugstore retailer released new packaging for its private label pistachios.


Paramount Farms International LLC has sued Walgreens for trademark infringement and unfair competition after the Deerfield, Ill.-based drugstore retailer released new packaging for its private label pistachios. The Los Angeles-based company claims that the drugstore retailer's packaging is an exact copy of the packaging for their Wonderful brand of Pistachios.
 
“By selling and offering for sale, infringing goods and services, Walgreens is in violation of Paramount's proprietary rights thereby constituting unfair competition,” says the 53-page complaint submitted by Roll Global, owner of Paramount Farms. The complaint also states that Walgreens is wrongfully using similar fonts, font colors, window curvature and packaging dress as the Wonderful brand.
 
As a result the complaint determines that “Walgreens' use of the infringing trade dress has confused the public, and is likely to continue to cause confusion.” The use of similar shapes, fonts and packaging shapes is a violation of the display of Paramount's unique product, according to the claim.
 
Paramount Farms is asking Walgreens to destroy all private label pistachio packaging and advertising materials immediately following the end of the lawsuit.
 
The lawsuit is being held in the state of California. Walgreens claims that it is unaware of the suit and declined to comment.
