Georgia-Pacific Sues Family Dollar Over PL Tissue

Atlanta-based Georgia-Pacific filed a lawsuit against Matthews, N.C.-based Family Dollar Stores Inc. and Duncan, S.C.-based Sun Paper Co., by closely copying the package design Georgia-Pacific uses for its Angel Soft and Quilted Northern brands, the Atlanta Business Chronicle reported.

According to the March 2 article, Georgia-Pacific claims Family Dollar recently began selling a line of private label bathroom tissue (under the Soft & Strong and Soft brands) made by Sun Paper with packaging and styling that is “obviously designed to trade upon the good will” of the packaging used for Angel Soft and Quilted Northern products. Georgia-Pacific further alleged that packaging even copies the trademarked diamond pattern embossing for Quilted Northern, which is decorative and not functional.

In its complaint, Georgia-Pacific also claims that Family Dollar’s tissue products have “compare to” statements on their packaging that mislead consumers into thinking the tissue has the same “performance” characteristics as the Angel Soft and Quilted Northern brands. Georgia-Pacific went on to claim that the Family Dollar products are “inferior.”
